CHANGES
TO LAND LAW SUBMITTED
(SGT-HCMC) A list of proposal amendments to
the Land Law has been submitted to the Government and is likely
to go before the National Assembly during its spring sitting;
Tuoi Tre reports.
The changes drawn up by the General Department of Land Administration
include provisions for delegating land-transfer and leasing
powers to local authorities.
Other changes in the list include the transfer and leasing
of land to owners of investment projects occupying at least
five hectares of urban land or 50 hectares of non-urban land.
City & provincial authorities would be entitled to handle
small instances of this.
The authorities of districts, municipalities and cities managed
by provinces, in particular, would be allowed to transfer
land to households and individuals for building houses.
The transfer of land-use rights would be undertaken at the
commune or district level.
Household and individual holders of land-use rights would
be allowed to lease their land to foreign-invested projects,
as long as the land continued to be used for the purpose already
stipulated.
They would also be allowed to use these rights as loan collateral.
Overseas Vietnamese investing and residing in HCMC or Hanoi
would be entitled to land-use rights to build housing.
The responsibility for approving land leases of 50-70 years
would pass from the National Assembly Standing Committee to
the Government.
